REGULATIONS OF THE BRATEX DEKER PUNKT LOYALTY PROGRAM

I. General provisions.

  1. These regulations define the rules of operation and conditions for participation in the Bratex Deker Punkt (BDP) loyalty program (hereinafter: Program).
  2. The organizer of the Program is Bratex Dachy Mrzygłód Spółka Komandytowa with its registered office in Dębica at Przemysłowa 22, 39-200 Dębica, entered into the Register of Entrepreneurs - National Court Register under KRS number 0000320498 by the District Court in Rzeszów, XII Commercial Division of the National Court Register, NIP: 8722225215, email : dekerpunkt@bratex.pl (next: Organizer).
  3. The aim of the Program is to bring together people working with the Organizer's products and to organize training courses, meetings and bonuses for them for constant cooperation.
  4. The program will be valid until canceled by the Organizer.
  5. The Program allows you to collect points on the basis of coupons delivered with products or coupons on special cards, and then exchange them for prizes available in the Program catalog, on the terms set out in these regulations.
  6. By joining the Program, the Participant is obliged to read these Regulations. In addition, by joining the Program, the Participant undertakes to comply with the rules contained in these regulations, and confirms that he meets all the conditions that entitle him to participate in the Program.
  7. These regulations are available on the website bratex.pl.

II. Conditions of Participation in the Program.

  1. Only an adult person who installs the Organizer's products on a regular basis, and in particular a professional tinsmith, roofer, fitter or fitter, can participate in the Program.
  2. In order to participate in the Program, the Participant is obliged to register in the Program by providing their personal data (in particular: name and surname, address, telephone number, e-mail address).
  3. The registration procedure in the Program begins with the indication, after installing the Application by the person referred to in par. 1 phone number to which the verification code will be sent via SMS. After entering the correct verification code, the Application will ask for the first code indicated on the coupon attached to the Promoter's products delivered to the final recipient. Entering the correct code will result in registration in the Program.
  4. The codes referred to in sec. 3 are placed only on coupons attached by the Organizer to the following products: metal roof tiles, trapezoidal sheets, snap seam, seam for seam in the form of panels and sheet metal in a circle, modular metal roof tiles, Struga gutter system and others, for which coupons with codes were delivered.
  5. A Participant may register for the Program only once.
  6. The Participant's registration in the program will take place automatically after the registration process is completed, of which he will be informed.
  7. The Organizer reserves the right to verify whether the Participant meets the conditions for participation in the Program.
  8. In the event of violation of the conditions of participation before registering in the Program and setting up an account, the Organizer will refuse to register in the Program and set up an account.
  9. In the event of a violation of the conditions of participation after registering in the Program and setting up an account, the Organizer will block or delete the Participant's account.
  10. Deletion of the Participant's account means exclusion from the Program, and the collected points are forfeited.
  11. Application for participation in the Program must be made in the manner indicated in the regulations. Failure to meet any of the conditions for applying for participation in the Program will invalidate the application for the Program.
  12. The person joining the Program agrees to the processing of his personal data.
  13. The Participant has the option of logging in to his account in the Program via the mobile application called Deker Point (hereinafter: the Application).

III. Earning points. Exchange points for prizes.

  1. After registering in the Program and setting up an account, the Participant receives the opportunity to collect points in the Program.
  2. In order to receive points, the Participant is obliged to enter, via the Application, the code indicated on the coupon attached to the Organizer's products delivered to the final collection.
  3. The Participant may collect points only for products that he personally or with the help/participation of co-workers installs at the facility.
  4. The participant has no right to collect points using codes received from unknown sources or in an unspecified place and in a manner inconsistent with the provisions of these regulations.
  5. If the Participant is found to have violated the rules on collecting points, the Organizer will refuse to assign points to the Participant in the scope covered by the violation.
  6. The Organizer has the right to verify the correctness of collecting points by the Participants and for this purpose the Organizer may in particular contact each Participant and explain the correctness of the submitted point application.
  7. The Participant receives points in the amount indicated in the currently valid catalog of prizes.
  8. Points are awarded in the amount taking into account the rules in force at the time of sending the code by the Participant.
  9. The Participant can check the current number of points accrued to him via the Application.
  10. In the event of withdrawal from the final customer from the sales contract for the Organizer's products for installing which the Participant received points, the Organizer reserves the right to withdraw the points awarded to the Participant.
  11. The right to withdraw the points awarded to the Participant is also vested in the Organizer in the event of noticing abuses or incorrect awarding of points.
  12. The points awarded to the Participant may be exchanged by the Participant for prizes.
  13. The current catalog of rewards in the Program is available via the Application.
  14. The value of each prize is expressed in points. The Organizer reserves the right to determine the point value of prizes at any time depending on variables, in particular taking into account the purchase price and delivery costs.
  15. The Organizer also reserves the right to update the catalog of prizes.
  16. The Participant with the appropriate number of collected points may, after logging into his account or via the Application, select and order prizes at the given address, the point value of which does not exceed the number of points collected by the Participant.
  17. After placing the order, the number of points on the Participant's account will be reduced by the value of the prizes.
  18. The Organizer reserves the right to temporarily change the number of points awarded, in particular taking into account the Organizer's promotional campaigns, of which the Participants will be notified.
  19. Prizes cannot be exchanged for money.
  20. Unused points are forfeited. The Participant is not entitled to receive a cash or material equivalent in exchange for unused points.
  21. The Participant may not transfer his rights to other persons.

 IV. Complaints procedure.

  1. Any complaints may be submitted to the Organizer within 14 days from the occurrence of circumstances justifying the submission of the complaint.
  2. Complaints delivered after the deadline referred to in paragraph 1 will not be considered.
  3. The complaint should be sent to the following e-mail address of the Organizer: dekerpunkt@bratex.pl.
  4. The complaint should include:
    1. first name Last Name,
    2. Phone number,,
    3. indication of the reason for the complaint
    4. justification of the complaint
  5. Complaints will be considered within 30 days from the date of its receipt.
  6. The person submitting the complaint will be informed about the decision to the e-mail address provided in the complaint.

V. Processing of personal data.

  1. The Program Participant agrees to the processing of his personal data by the Organizer, in accordance with the provisions of the General Data Protection Regulation (Journal of Laws UE.L 2016 No. 119, p. 1; hereinafter: GDPR) for purposes related to participation and conducting the Program.
  2. The participant agrees to receive information about organized promotional campaigns. By agreeing to receive marketing information, the Participant agrees to be sent electronically to the e-mail address provided, by message to the provided number and the Application, commercial information, including information about promotions covered by the Program.
  3. The Program Organizer informs that:
    1. The administrator of the Participants' personal data is Bratex Dachy Mrzygłód Spółka Komandytowa with its registered office in Dębica at Przemysłowa 22, 39-200 Dębica, entered into the Register of Entrepreneurs - National Court Register under KRS number 0000320498 by the District Court in Rzeszów, 8722225215th Commercial Division of the National Court Register, NIP: XNUMX , email: dekerpunkt@bratex.pl;
    2. Participants' personal data will be processed on the basis of art. 6 sec. 1 a) GDPR in order to participate in the Program and may be made available to entities authorized to do so under applicable law and concluded contracts;
    3. Participants have the right to request from the administrator access to their personal data, rectification, deletion or limitation of processing and the right to object to the processing and the right to transfer data;
    4. Participants have the right to lodge a complaint with the supervisory authority;
    5. This data will be processed for the duration of the Program;
    6. Providing personal data by Participants is optional, but failure to provide them prevents participation in the Program or receiving promotional offers.

 VI. Final Provisions.

  1. These regulations are subject to Polish law.
  2. The Program Organizer reserves the right to change the rules and conditions of the Program during its duration.
  3. The Participant may resign from participation in the Program at any time.
  4. Deleting the Participant's account also means losing his rights resulting from membership in the Program and will be tantamount to expiration of membership.
